BluText provides tools for SMS-based communication. You are solely responsible for how you use our platform, and you must ensure all your activities comply with applicable laws and regulations, including but not limited to the Telephone Consumer Protection Act (TCPA) and carrier guidelines.

You agree not to use BluText for any unlawful purpose, including but not limited to sending unsolicited messages or violating telecommunications rules.

2. No Responsibility for Carrier Actions

You acknowledge and agree that BluText:

• Is not affiliated with or endorsed by any mobile carrier.
• Has no control over how mobile carriers monitor or enforce their policies.
• Is not responsible if your phone number is blacklisted, suspended, or permanently shut down by a carrier due to your use of our Services.
• Will not be liable for any disruptions, damages, or losses resulting from such shutdowns or enforcement actions taken by carriers.

3. TCPA Compliance Is Your Responsibility

By using BluText, you affirm that:

• You understand the requirements of the TCPA, CAN-SPAM, and all applicable communication laws.
• You will obtain prior express written consent from all recipients before sending any promotional or marketing messages.
• You accept full responsibility and legal liability for any violations of the TCPA or similar laws that result from your use of our Services.

BluText does not provide legal advice, and nothing in our Services should be interpreted as such. You are solely responsible for ensuring that your messaging practices are compliant.

4. Limitation of Liability

To the fullest extent permitted by law, BluText disclaims all liability for any direct, indirect, incidental, consequential, or punitive damages, including but not limited to:

• Loss of business or revenue due to carrier-related account shutdowns.
• Legal claims, fines, penalties, or lawsuits resulting from TCPA violations.
• Loss or corruption of data, reputational damage, or service interruptions.

Our Services are provided “as-is” and “as available” without warranties of any kind.

5. Indemnification

You agree to defend, indemnify, and hold harmless BluText, its owners, employees, agents, and affiliates from and against any claims, liabilities, damages, judgments, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to:

• Your violation of any law, including the TCPA;
• Your misuse of the Services;
• Any messages sent using your account.

6. Termination

We reserve the right to suspend or terminate your access to the Services at any time for any reason, including suspected misuse or legal risk.

7. Modifications

We may update these Terms at any time. Continued use of the Services after changes constitutes acceptance of the new Terms.
